Maersk monitors Tecon 10 process and reiterates stance on competition

Maersk states it is closely monitoring the process regarding the lease of the Tecon10 Terminal in Santos. Following the release of a note by the Administrative Council for Economic Defense (CADE), which acknowledged the existence of relevant arguments on both sides, the company reaffirmed its position on the importance of ensuring balanced competition and transparency throughout the bidding process. A.P. Moller-Maersk believes that Joint Technical Note No. 1/2025 from CADE’s General Superintendence and the Department of Economic Studies is consistent with recent Council decisions and with positions already expressed by other public administration bodies, stating that there are no grounds to justify the exclusion of incumbent or vertically integrated operators from the Tecon Santos 10 auction. According to the document itself, such restrictions “would violate proportionality” and the mere identification of risks “does not confirm that they would materialize.” The document also reinforces the sectoral policy of broad competition in the auction defined by the Ministry of Ports and Airports (MPOR), the legitimate concerns raised by ANTAQ’s technical staff, and the opinion of the Ministry of Finance — all converging on the goal of ensuring broad competition and equal treatment for participants who meet the tender requirements.
