The decision responds to a request from the Federal Public Defender’s Office (DPU), the Federal Prosecutor’s Office (MPF), and the Alagoas State Prosecutor’s Office (MP/AL), which warned of serious environmental risks, risks to the population, potential for tourism, and fishing activity.

Understand the case

In 2020, the French multinational Timac obtained a license to build a liquid bulk storage terminal through an auction held by the National Waterway Transportation Agency (Antaq). The project aimed to receive and store sulfuric acid to supply the company’s fertilizer plant located in Santa Luzia do Norte, in the interior of Alagoas.

The terminal would be built on an area of almost 8,000 square meters in the port, located between the main urban beaches of the capital.

The Risk: Sulfuric acid is a highly reactive and dangerous substance. In contact with sewage, rivers, and lagoons, it can generate hydrogen sulfide (toxic), and when diluted with water and reacting with metals, hydrogen gas (flammable).

After strong public pressure, the initial environmental authorization to store sulfuric acid at the location was revoked. In May 2024, the DPU, MPF, and MP/AL submitted a joint recommendation. The agencies questioned the lack of a proper environmental impact assessment before qualifying the terminal, since Antaq’s Technical, Economic, and Environmental Feasibility Study (EVTEA) did not assess the risks of the project.

Change in the Contract: Currently, Antaq has acknowledged the possibility of transferring ownership of Timac’s leasing contract to Tecal Terminal de Combustíveis de Alagoas. The transfer process was authorized and is currently under review by MPOR’s legal department. The request submitted by Timac and Tecal proposes removing the specific reference to “sulfuric acid” from the contract, keeping only the cargo profile as liquid bulk.

The data used to formulate the rankings below were gathered using DataLiner, Datamar’s cutting-edge business intelligence platform.

Brazil

Keeping its traditional score regarding containerized cargo exports, the Port of Santos ranked first in the 1st quarter of 2023, with 228,935 TEUs handled, a performance that reveals a 20.23% drop compared to the same period last year.

The Port of Paranaguá, which ranked second in containerized cargo exports, handled 106,396 TEU between January and March this year, 11.22% more than in the same period last year. See more information in the table below:

The ranking of imports via containers also counts with the leadership of the Port of Santos, with 243,098 TEU imported, a number 5.35% lower than that seen last year. However, the Port of Navegantes, the country’s second-largest port in containerized cargo imports, recorded an impressive mark of 107,115 TEU, 52.07% more than in the first quarter of 2022.

In third place, the Port of Paranaguá imported 61,243 TEU, while Itapoá, in fourth place, saw 53,525 TEU in container imports, up 34.17% from the same period of last year. See more information below:

Plate region (Argentina, Uruguay, Paraguay)

In terms of exports, the Port of Buenos Aires scored the highest among the ports in the Plate region, with 85,355 TEU handled, indicating a simple growth of 1.65% compared to last year, a situation consistent with the current scenario of drought and currency crisis the country is going through.

The port of the Uruguayan capital faced a weak first quarter in container exports, documenting 49,015 TEU, down 16.13% compared to January-March 2022. Even so, the Port of Montevideo finished second in the ranking. See more below:

Last but not least, the port of Buenos Aires saw the importation of 106,473 TEU of containers, a drop of 23.51% over the first quarter of last year, also a reflection of the severe currency crisis and the depletion of dollar reserves in the country. The runner-up in the region was the Port of Montevideo, with 55,929 TEU imported via containers in the three-month period, according to DataLiner data.

Regarding imports via containers, the leadership in January also belongs to the Port of Santos, with 84,059 TEUs, a drop of 7.36% compared to January 2022. In the Plate region (Paraguay, Uruguay, and Argentina), the Port of Buenos Aires led exports in January, with 26,394 TEUs, a volume 11.64% lower than January 2022. The Port of Montevideo, second in the ranking, exported a 14.74% lower volume in the same period. See more information below:

In the region that includes Argentina, Paraguay, and Uruguay, the leadership in exports in 2022 was the Port of Buenos Aires, with 364,513 TEUs, a volume 6.37% lower than in 2021. The Port of Montevideo, second in the ranking, grew 2.02% in the same period. See more information in the table below:

Brazil ports

The Port of Santos continues to lead Brazilian exports via containers, with a 1,050,435 TEU throughput in the first 11 months of 2022, a volume 3.08% greater than in the same period of 2021. Plate

In the other countries on the East Coast of South America (Argentina, Paraguay, and Uruguay), the port that carried out the most export activities via containers was the Port of Buenos Aires, with 336,773 TEUs dispatched between January and November 2022. This figure is 6.53% lower than the same period in 2021. Comparatively, the Port of Montevideo, second in the ranking, exported volumes 1.85% higher than in 2021. See the ranking below:

The Port of Santos leads the ranking of Brazilian containerized exports, with 851,005 TEUs from January to September 2022, a slight increase of 1.19% compared to the same period in 2021. The Port of Santos maintained its top spot in the ranking of container exports in the first eight months of 2022, with 741,665 TEU, a slight decline of 0.57% from the volumes exported in the same period of 2021. In terms of imports, the Port of Santos, which leads the ranking, saw a total volume 4.47% lower than in the first seven months of 2021. The volume at the Port of Navegantes fell by 15.96% and at Paranaguá by 11.1%. See the full table below:

In the Plate region, the port that led in container exports in the first seven months was Buenos Aires, with a volume 4.34% lower than in 2021. On the other hand, the Port of Montevideo grew 11.07% in the same timeframe.

The Port of Santos was the one with the most exports of containers in the first half of 2022, with 555,892 TEUs, a volume in line with exports in the same period of 2021. The second place in the ranking, Paranaguá, exported a volume 11.19 % higher in comparison. See more of it below:

In the Plate region (Paraguay, Uruguay, and Argentina), while the first in the ranking, the Port of Buenos Aires, exported a volume, measured in TEUs, 5.09% lower in the first half of 2022 compared to the same period in 2021. As for imports among the ranking of ports from the Plate region, the Port of Buenos Aires had an imported container throughput of 270,859 TEUs in the first half of 2022, a decrease of 3.54% compared to the same period in 2021.
